Profiles’ Lis Pendens Reports contain all lis pendens filings

tax default filings are made by the City of New York.

How long have taxes gone unpaid before
the property appears on the Lis Pendens Report?
Generally speaking, if a tax payment has not been made for one
year, a filing is made by the City of New York.

How long
has a mortgage been delinquent before the property appears on the LIS
PENDENS REPORT?
Generally speaking, if a mortgage payment has not been made for three
consecutive months, a lis pendens for mortgage default is filed. This
is the first step in the foreclosure process.

How long
after the lis pendens for mortgage default filing is made with the Court
will the filing be reported on the Lis Pendens Report?
Generally 5- 10 days. During this time, Profiles is gather further information
about the property that is not including in the filing with the Court.

How can I find
out the balance remaining on the delinquent mortgage or tax lien?
The remaining balance of the delinquent mortgage or tax lien is sometimes
included in the Complaint.
You can examine all papers in the foreclosure file at the County Clerk’s

Who do
I contact if I see a property on the Lis Pendens Report that I like?
You should contact the property owner Defendant)
directly by one of the following methods: Letter, Telephone, or In Person.

What type
of letter should I write?
The type of letter you write depends on what you have to offer the homeowner.
However, any letter should be short, to the point and empathetic to
their current financial woes.

Do you provide
the property owners telephone number?
No we dont. Telephone numbers are not part of the public record.
We suggest that you obtain the property owners telephone number
directly from the telephone company. You can also find telephone numbers
on the Web. Try www.switchboard.com,
www.anywho.com,
www.verizon.com
or www.whitepages.com.

Why shouldnt I contact the bank
or other mortgage holder or City of New York directly?
Generally, the bank, other mortgage holder or City of New York will
not be of much assistance at the lis pendens stage. Although the property
owner is currently in default, they are still the owner of the property.
Therefore, any arrangement regarding the mortgage in default or the
unpaid taxes has to go through the property owner. However, you could
contact the Plaintiff's attorney if you are interested in purchasing
the mortgage in default.

If I purchase a property directly from
the property owner during the lis pendens for mortgage default stage,
who is responsible for any other liens that may be held against the
property?
The person who BUYS the property from the delinquent homeowner is usually
responsible for satisfying any other liens held against the property.
Disposition of liens should be negotiated with the homeowner and/or
your attorney prior to your purchase of the property.

How do I know if the lis pendens for
mortgage default is a 1st, 2nd or even 3rd
mortgage?
Using the block
and lot number provided for each property you can obtain a printout
free of charge from the City
Registers office. This printout will list all outstanding
mortgages currently held against the property, and the date they were

How long after the filing of a lis pendens
does the property reach the auction block?
In most cases, approximately 12 to 18 months.

I thought lis pendens information was
public record. Doesnt the city or county have a list of lis pendens
filings?
It is true that lis pendens are public record. However, the public record
is housed in various departments and therefore, there is no central
"list" of lis pendens filings available directly from the
City of New York, or the individual boroughs. Profiles’ compiles
foreclosure data from the various departments and agencies into comprehensive,
borough-specific, user-friendly reports.

How can I find out additional information
about the properties in the Lis Pendens Report?
Additional information can be obtained on each property where a lis
pendens for mortgage default or tax
lien has been filed. Outstanding liens and judgments can be obtained
from the County
Clerks office in each borough. Additionally, at the City
Registers office, you can obtain a printout and complete history
of each property on the Lis Pendens Report by referencing the block
and lot number provided for that property.
